↓ Product Legal? ↓ Operator Authorized? ↓ Affiliate Relationship Permitted? ↓ Affiliate Registration Needed? ↓ Traffic Source Allowed by Contract? ↓ Ad Platform Allows It? ↓ Creative Compliant? ↓ Landing Compliant? ↓ Audience Eligible? ↓ CRM Consent / Suppression Valid? ↓ Tracking Proves Correct Traffic? ↓ Evidence Preserved? ↓ Status Still Current?

№ Compliance layer
3 Operator Authorized/licensed ли operator?
4 Affiliate Нужно ли affiliate registration/certification?
6 Platform Разрешает ли Google/TikTok/etc. эту category?
7 Audience Legal age и targeting соблюдены?
8 Creative Claims, bonus, personalities, disclosure compliant?
9 Landing Operator links, terms и RG blocks актуальны?

Europe LATAM USA Canada.

В Великобритании: Great Britain и Northern Ireland нельзя автоматически считать идентичными gambling GEO.

Minimum GEO record

Country State / Province Regulator Market Status Legal Age Products Last Verified Next Review.

Не использовать free-text GEO

Плохо: Ontario traffic. Лучше: CA-ON. Плохо: UK. UKGC framework: GB.

Layer 1 — Jurisdiction Eligibility

Regulatory Map

На уровне database:
Jurisdiction Casino Sports Poker Other Status
GEO A yes yes verify verify active
GEO B no yes no verify active
GEO C verify verify verify verify research

Verify лучше ложного Yes

Product-level legality

Casino: к poker. Lottery: к sportsbook.

Example: United States

Google также строит U.S. gambling advertising around appropriately licensed state markets и требует state-restricted targeting для соответствующих gambling categories. Следовательно: US × product × state а не: US gambling = yes.

Layer 2 — Product Eligibility

Layer 3 — Operator Authorization

Legal Entity Trading Brand Domain Licence / Authorization Number Product Status Checked Date.

Brand Name ≠ Authorization

Одинаковый consumer brand может:
  • использовать разные legal entities;
  • иметь разные licences;

SPA публикует current list authorized fixed-odds betting companies, где связаны: company CNPJ brand domain authorization act.

Brazil federal domains

Не: Brand X = licensed. А: Brand X | Entity Y | Domain Z | Authorization A | checked 2026-09-22.

Layer 4 — Affiliate Regulatory Status

  • ничего отдельного;
  • registration;
  • vendor approval;
  • certification;
  • operator filing;
  • advertising-specific obligation.

Market B.

Netherlands example

Australia example

Lesson

Layer 5 — Affiliate Agreement

Contract Compliance Fields

Field Example status
Paid Search allowed
Brand Bidding prohibited
SEO allowed
Paid Social approval required
Influencers prohibited
Email consent + approval
Sub-affiliates written approval
Incentivized prohibited

Verbal permission

Great Britain shows why operator contracts become compliance tools

UKGC LCCP 1.1.2 requires licensees to take responsibility for contracted third parties and to structure contracts so third parties operate as though bound by relevant licence conditions/codes; contracts must also enable prompt termination, including where an affiliate breaches a relevant advertising code.

Operator due diligence goes both ways

Affiliate checks operator. Operator checks affiliate. That is normal in regulated markets.

Due diligence package

Affiliate should be ready to provide: Legal Entity Domains Traffic Sources GEOs Sub-affiliates Creative Process Compliance Contact Tracking Method.

Layer 6 — Traffic Platform Eligibility

Regulator approval does not imply: Google approval. TikTok approval. Any other platform approval.

Platform is a separate hard gate

Use: Legal Status and: Platform Status as different database fields.

Google Ads

Google currently supports gambling and gambling-promoting advertising only in specified countries/categories and where country-specific criteria and certification requirements are met. Gambling ads must target approved markets, display responsible-gambling information and not target minors.

Google affiliate rules

Where gambling-promoting affiliate content is available: affiliate/aggregator destination:
  • must not itself offer gambling;
  • must promote only products/operators meeting target-market authorization requirements.

Google 2026 licensing disclosure requirements

Current policy requires licensed operators to display licence details. For gambling-promoting affiliates not themselves required to hold a licence, the advertised domain must link exclusively to fully licensed/authorized gambling entities in the targeted geography and carry a prominent statement confirming that outbound links meet that condition.

Google certification is not permanent entitlement

Advertisers must maintain required licence/authorization/registration while certified and notify Google if it expires, is suspended or terminated.

Google policy health became more important in 2026

From 23 March 2026 Google strengthened gambling certification requirements around account/MCC policy health and reiterated that certified domains must be directly owned and controlled rather than free-hosted third-party subdomains. From 14 September 2026, Google expanded those strengthened certification-health requirements across all Gambling and Games categories.

Platform Compliance Registry

Store: Platform Category GEO Certification ID/Status Domain Expiry/Review Account MCC Last Policy Check.

One certified domain ≠ all domains

Don't clone landing to random domains assuming certification follows account.

TikTok Ads

TikTok's current Gambling and Games policy was updated in August 2026. It requires gambling advertisers to pass certification, comply with market-specific geographical/legal restrictions and avoid targeting minors.

TikTok affiliate eligibility is not universal

TikTok's current market rules in several cases explicitly exclude: aggregate or affiliate sites that promote gambling-related content. Therefore: “TikTok allows online casinos in country X” does not imply: “TikTok allows your gambling comparison affiliate site.”

Platform categories must be checked literally

Operator. Affiliate. Information product. Social casino. Fantasy.

Do not use cloaking as compliance strategy

If platform does not permit campaign: do not conceal:
  • destination;
  • product;
  • operator;
  • actual geography.
That creates additional circumvention risk rather than solving eligibility.

Layer 7 — Audience Eligibility

Even compliant gambling product cannot be advertised to everyone.

Minimum age

Legal age can differ by:
  • country;
  • state;
  • province;
  • product.
Therefore: age = jurisdiction data, not global site constant.

Never use one universal 18+

Some markets require: 18+. Others: 19+. Others/platform categories may effectively require: 21+ targeting.

Audience Age Field

Store: Legal Gambling Age Platform Minimum Operator Minimum and use: most restrictive applicable requirement.

Underage Protection

Compliance includes: targeting and: creative. These are different.

Great Britain example

CAP Section 16 requires gambling advertising to be socially responsible and specifically protect children, young persons and vulnerable people; Section 16 explicitly includes third-party affiliate marketers acting on behalf of the advertiser.

Targeting alone does not cure unsuitable creative

An ad can: target adults and still be inappropriate because of:
  • imagery;
  • personality;
  • youth culture;
  • messaging.

Netherlands uses a different protection model

Ksa states affiliate online advertising can remain possible under the untargeted-advertising restrictions only under strict conditions, including evidence that 95% of visitors are 24 or older and giving all visitors an option to view the site without exposure to gambling ads; the outcome must be that vulnerable groups do not see the ads.

Same objective, different mechanics

GB: CAP strong-appeal/underage framework. Netherlands: strict online targeting and young-adult/vulnerable-group restrictions. Therefore: global creative template cannot rely only on: 18+.

Influencer Compliance

Creator campaigns require separate checks for: creator age audience age public profile youth appeal market rules ad disclosure.

Netherlands 2026 example

In February 2026 Ksa clarified that influencers, streamers and comparable online personalities fall within its role-model prohibition for promotion of online gambling and told licensees to end such collaborations.

Lesson

Influencer allowed in one GEO: does not imply: influencer allowed in another.

Layer 8 — Operator / Offer Claims

An offer can be real and still be advertised incorrectly.

Offer Compliance Questions

Is the bonus valid today? Is public promotion permitted? Are material conditions shown? Is wording misleading? Does creative imply guaranteed profit? Is urgency permitted?

Never copy offer from operator homepage manually

Offer conditions change. Use: central offer feed/database.

Offer Record

Operator Jurisdiction Product Headline Terms Wagering Start End Public Promotion Allowed Last Verified.

“Best Bonus” is compliance-sensitive content

High commercial value. High maintenance.

Financial-success claims

A common global risk: framing gambling as:
  • guaranteed profit;
  • investment;
  • salary alternative;
  • solution to debt.
These claims are heavily restricted in regulated markets.

Brazil 2026 makes this explicit

July 2026 interministerial Brazilian rules apply to persons/entities that produce, promote, sponsor, distribute or otherwise disseminate fixed-odds betting marketing. The rules identify promotion of unauthorized operators, affiliate links to unauthorized operators, easy-gain messaging, gambling-as-investment/income framing and false representations of win probabilities among problematic conduct.

Brazil warning requirement

From 17 July 2026 fixed-odds betting advertising must carry one of the specified Ministry warnings; the warning must be clearly legible and occupy at least 10% of the ad area.

Why global creative libraries need local modules

creative_master.psd with one fixed footer is not enough.

Better component system

Message GEO Warning Legal Age Responsible Gambling Operator Identity Disclosure.

Layer 9 — Advertising Disclosure

Commercial affiliate content should not masquerade as independent editorial material where applicable advertising rules require recognisability.

Editorial vs Commercial

A page can contain: editorial information. But: paid placement, affiliate CTA, sponsored recommendation may trigger commercial disclosure requirements.

Disclosure should answer

Who benefits commercially? Is ranking influenced by partnerships? Does publisher receive commission?

Don't hide it 10,000 words below

Disclosure needs to be where users can realistically understand the commercial relationship.

Affiliate Disclosure ≠ Licence Disclosure

These are different. You may need: commercial relationship disclosure and: operator/regulatory information.

Layer 10 — Landing Page Compliance

Advertising compliance does not end at the ad. Destination matters.

Landing Pre-flight

Check: Correct GEO Correct Operator Correct Domain Current Offer Legal Age Responsible Gambling Commercial Disclosure Terms Privacy No prohibited operators.

Every outbound operator link is regulatory data

It should not be treated as: random CMS hyperlink.

Operator Link Registry

operator_id jurisdiction_id domain status last_verified active.

Automatic CTA Kill Switch

If: licence suspended, operator exits market, domain changes, set: active = false. All site CTAs disappear automatically.

Google makes link hygiene especially important

Its current gambling-promoting affiliate policy requires eligible affiliates to link only to licensed/authorized gambling entities in the target market.

Australia shows the downside of stale links

ACMA's 2026 enforcement includes blocking affiliate marketing websites connected to prohibited or unlicensed online gambling services.

Layer 11 — Responsible Gambling

Responsible gambling should not be treated as: one generic footer URL.

Minimum architecture

Depending on GEO/platform: Age Warning Responsible Gambling Message Help Resources Self-Exclusion Resource Terms Operator Status.

Market-specific resources

Don't send every user worldwide to: same U.S. hotline. Use local resources.

Responsible-gambling page should not become aggressive sales funnel

Safety/help intent should remain separated from commercial CTAs where local rules expect such separation.

UK example

UKGC expects gambling advertising to comply with socially responsible marketing requirements, and its LCCP/marketing framework imposes operator responsibility for affiliate activity.

Layer 12 — Self-Exclusion and Suppression

This is where compliance becomes data engineering.

Self-exclusion is not just operator UI

It affects: CRM retargeting audience uploads promotional messages.

UK example

UKGC requires licensees to take all reasonable steps to stop marketing material going to self-excluded customers, including when third-party affiliates perform marketing. Its guidance states gambling businesses using affiliates for direct marketing remain responsible for relevant failures.

UK incidents can be material

UKGC expects incidents where an operator or affiliate sends marketing material to self-excluded customers to be reported as key events.

Brazil example

Brazil's centralized self-exclusion system can:
  • block accounts across authorized betting sites;
  • block new registration;
  • prevent targeted betting advertising to the self-excluded person.

CRM implication

You need: suppression infrastructure, not Excel memory.

Recommended CRM permission model

user_id jurisdiction product channel consent suppressed self_excluded last_updated.

Consent and self-exclusion are different states

A user can have historical: email_consent = yes and later become: self_excluded = yes. Suppression overrides marketing consent.

Don't delete suppression records blindly

If you erase all evidence of suppressed user: you may accidentally reacquire/contact them later. Handle this according to applicable privacy law and compliance requirements.

Never use self-exclusion as marketing segmentation

Not: “former high-value gambler”. Self-exclusion data exists for protection/compliance.

Direct Marketing Compliance

Email and SMS require more than: user once entered address.

Fields to document

Consent Source Consent Text Timestamp Product Channel Jurisdiction Withdrawal Time Suppression.

Bought Lists Are High Risk

Third-party provider saying: “all leads are compliant” does not replace your evidence.

Evidence question

Can you prove: what exactly the user agreed to?

Layer 13 — Sub-Affiliates

Affiliate network adds another compliance layer.

Sub-affiliate chain

Operator ↓ Master Affiliate ↓ Sub-affiliate ↓ Influencer / Publisher ↓ Player.

Compliance risk increases with opacity

If operator/master affiliate cannot answer: Who actually generated this click? control is weak.

Minimum Sub-affiliate Registry

SubID Legal Entity Domain Traffic Source GEO Approved Contract Last Review.

Don't allow anonymous sub-affiliates

At scale, this prevents:
  • investigation;
  • source control;
  • creative control.

Brazil direction of travel reinforces traceability

SPA's 2026–2027 regulatory agenda contains a dedicated initiative to revise internet affiliate advertising requirements and improve rules, conditions and technical requirements; as of 22 September 2026 this initiative is still Em desenvolvimento. Public consultation material includes proposals around greater affiliate/sub-affiliate traceability and responsibility, but those consultation suggestions should not be presented as current law until adopted.

Critical distinction: current rule vs proposal

Compliance database should classify source as: Effective Law Effective Regulation Platform Policy Regulator Guidance Consultation Proposed Rule Internal Policy.

Never flatten these into one “rule” column

A consultation idea: is not enacted law. A platform policy: is not statute. An operator contract: is not national regulation. But all can affect whether campaign can run.

Source Hierarchy

For legal/regulatory claims: Regulator / Government then: official legislation. For advertising: Advertising authority then: platform policy. For commercial: Operator agreement. For economics: First-party data.

Layer 14 — Influencers and Creators

Influencer should be treated as: traffic source + creative + publisher not celebrity shortcut.

Creator Compliance Record

Name/ID Market Audience Age Platform Approved Script Disclosure Operator Campaign Dates.

Prohibit uncontrolled improvisation

If regulated creative requires: specific warning, creator cannot freely remove it.

Livestream risk

Live content can be harder to pre-approve. Need:
  • script guidelines;
  • prohibited claims;
  • moderator/escalation process.

Netherlands makes role-model analysis mandatory

Current Ksa clarification treats influencers, streamers and comparable online personalities as role models that cannot be used to promote online gambling. So: creator strategy should have: allowed_by_geo.

Layer 15 — SEO Compliance

Organic search is not outside regulation.

SEO page can be commercial communication

A review page containing: affiliate links and: operator promotion can still engage advertising/commercial requirements.

SEO Compliance Fields

GEO Product Operators Offer Date Disclosure RG Block Last Regulatory Review.

Don't rank illegal operators because keyword volume is good

This is especially important in markets actively enforcing against illegal affiliates.

Netherlands

Ksa specifically targets affiliates promoting illegal gambling operators.

Australia

ACMA blocks illegal affiliate websites as part of enforcement under the Interactive Gambling Act framework.

SEO traffic does not create legal immunity

Organic click: still leads to promotion.

Review-page freshness

Every commercial page should carry: Last Verified and ideally: Operator Status Checked.

Avoid “best casino worldwide” pages

Without: jurisdiction selection such pages easily expose users to ineligible operators.

Better architecture

Global informational page: ↓ GEO selector: ↓ local operator list.

Layer 16 — Paid Search Compliance

Paid Search requires both: market compliance and: platform certification.

Search Launch Gate

GEO allowed? Affiliate category allowed? Domain certified? Operator allowed? Keyword allowed by contract? Ad creative compliant?

Brand Bidding

Three separate questions:
  1. Does law/regulator allow the advertising?
  2. Does platform permit it?
  3. Does affiliate agreement permit brand bidding?
Only if all pass: launch.

Don't treat Google approval as legal opinion

Google certification does not replace: local regulatory verification. Google itself requires advertisers to comply with local gambling laws and industry standards.

Layer 17 — Paid Social Compliance

Paid Social often introduces:
  • age-targeting risk;
  • creative/personality risk;
  • rapid creative iteration.

Compliance needs same velocity as creatives

If team makes: 100 ads/week, manual legal review of all ads by email: does not scale.

Build approved component library

Allowed CTA Allowed Claims Required Warning Prohibited Phrases Talent Restrictions Visual Restrictions.

Creative Versioning

Each asset: creative_id geo operator compliance_version approved_at.

TikTok specifically requires market/certification review

Its August 2026 policy requires certification and market-specific restrictions and explicitly says ads may not target minors.

A platform's “Gambling Information” category may differ from affiliate marketing

Don't assume informational-looking landing falls into harmless category. Read category definition.

Layer 18 — Native / Display

The main compliance risk: placement opacity.

Ask network for

publisher/domain reports GEO controls age controls exclusion lists.

Unknown inventory is not automatically acceptable inventory

Great Britain example

UKGC says operators and their contracted marketing affiliates must not place digital gambling advertising on websites providing unauthorized access to copyrighted content.

Therefore domain-level placement reporting matters

Not just: network name.

Layer 19 — Fraud vs Compliance

Fraud and compliance overlap but are not identical.

Example

Traffic may be real: human user, real deposit, but: wrong jurisdiction. That is not bot fraud. But it can be: non-payable/non-compliant traffic.

Rejection Taxonomy

Separate: Fraud Duplicate Wrong GEO Underage KYC Source Violation Attribution Operator Policy.

Compliance data belongs in BI

Otherwise team sees: CPA dropped without knowing: source violation caused rejection.

Layer 20 — Tracking and Evidence

A mature compliance system must prove: what happened.

Evidence is not only legal documentation

It includes:
  • click source;
  • creative;
  • landing version;
  • operator destination;
  • user GEO;
  • consent version.

Evidence Chain

Campaign ID ↓ Creative ID ↓ Landing Version ↓ Operator Link ↓ Click ID ↓ Conversion ↓ Approval/Rejection.

Why this matters

If operator says: traffic violated Paid Social restriction, you need: source-level evidence.

S2S tracking helps compliance too

Not only attribution. It lets you identify: which campaign generated: wrong GEO, rejection, duplicate, QFTD. Подробнее: S2S tracking и postback.

Required Compliance Dimensions in Tracker

Jurisdiction Source Campaign Creative Landing Operator Offer Sub-affiliate.

Layer 21 — Evidence Register

Every important compliance decision should have evidence.

Minimum Evidence Record

Field Example
Control Operator authorized
Jurisdiction BR
Evidence Source SPA
Status Pass
Checked 2026-09-22
Reviewer Compliance
Evidence Copy/Ref internal
Next Review 2026-10-22

Evidence should be reproducible

Another team member should be able to answer: Why was campaign allowed? without asking original media buyer.

Screenshot alone is weak evidence

Better: source reference date stored relevant extract decision.

Evidence Versioning

If policy changes: do not overwrite history. Keep: v1 v2 v3.

Why

You may need to know: which rule governed campaign in June, not only current September rule.

Regulatory Change Log

Minimum: Effective Date Published Date GEO Source Change Affected Assets Owner Deadline Completed.

Published Date ≠ Effective Date

Crucial distinction. A rule can be: published today but effective next month.

Status model

Announced Scheduled Effective Repealed Under Consultation.

Brazil illustrates this well

Its current legislation page continued to receive regulatory updates through 17 September 2026. Its dedicated affiliate-advertising revision remains in development rather than effective final regulation.

Layer 22 — Regulatory Monitoring

Compliance review once per year: not enough for volatile markets.

Three cadences

Continuous / Event-driven

Platform policy. Regulator announcement. Operator licence status.

Monthly

Operator list. Offer terms. Affiliate contract notices.

Quarterly

Full market compliance audit.

High-volatility markets need faster review

Example: Brazil.

Mature markets also change

Example: Great Britain LCCP current version became effective 29 July 2026. Mature ≠ static.

Platform rules may change faster than law

Google expanded strengthened gambling certification criteria on 14 September 2026. TikTok's current gambling policy was updated in August 2026.

Layer 23 — Regulatory Expiry

Every compliance approval should expire internally.

Example

operator_status_checked = 2026-09-22 review_due = 2026-10-22.

Expired record should produce warning

Not silently continue.

High-risk fields need shorter expiry

Operator Licence Platform Eligibility Offer short.

Stable informational fields

Historical statute background: longer review cycle.

Compliance Severity Levels

Useful internal framework:
Level Meaning Action
P0 Illegal/ineligible operator/product Stop immediately
P1 Underage/self-exclusion/source violation Pause + investigate
P2 Missing warning/disclosure/terms Fix before launch
P3 Evidence stale Review/renew
P4 Documentation improvement Schedule
Internal framework only. Not regulatory standard.

Hard-stop violations

Examples: Operator unauthorized Product prohibited Required licence missing Affiliate registration missing Platform category prohibited Targeting minors Self-excluded marketing Cloaking/circumvention.

Soft issue is different

Example: internal screenshot naming inconsistency. Do not treat all issues equally.

Compliance Risk ≠ Expected Fine

Do not create model: expected fine < expected profit → launch. For regulated acquisition, enforcement can also cause:
  • contract termination;
  • certification loss;
  • operator relationship loss;
  • domain/account disruption.

Great Britain operator risk example

LCCP 1.1.2 explicitly requires contracts to permit prompt termination for relevant affiliate breaches.

Google account risk example

Repeated certificate revocations or violations within MCC structures can affect future certification eligibility.

Australia site risk example

ACMA can request ISP blocking of illegal gambling and affiliate sites.

Compliance therefore affects business continuity

Not only legal expenses.

Global GEO Compliance Matrix

Market Main regulator/source Affiliate-specific issue Key acquisition risk
Great Britain UKGC + ASA/CAP operator responsible for contracted affiliates creative/CRM/third-party compliance
Brazil SPA/MF + consumer/advertising rules affiliate framework active + further rules developing operator/domain + fast rule changes
Netherlands Ksa strict affiliate/online-ad targeting vulnerable/young-adult exposure
Australia ACMA affiliate sites promoting illegal gambling can be blocked illegal casino/operator links
United States state regulators requirements vary by state product/state mismatch
Canada provincial frameworks province-specific market rules treating Canada as one GEO
This is a navigation table, not legal advice.

Great Britain: compliance pattern

Core concept: operator accountability for affiliates. UKGC requires licensees to control contracted third parties as though relevant licence conditions/codes applied to them. CAP Section 16 explicitly includes affiliate marketers acting on behalf of gambling advertisers.

Brazil: compliance pattern

Core concept: authorized operator/domain + fast-evolving advertising rules. SPA current authorization registry maps legal companies to brands/domains. July 2026 rules broadened responsibilities across betting advertising participants and imposed mandatory warning requirements. Further affiliate-specific internet-advertising regulation remains under development.

Netherlands: compliance pattern

Core concept: targeted online advertising and vulnerable-group protection. Ksa's 2026 guidance stresses that online gambling ads must not reach vulnerable groups and that in some cases a platform may be unsuitable even where targeting filters exist.

Australia: compliance pattern

Core concept: do not promote prohibited/unlicensed interactive gambling. ACMA actively blocks both illegal gambling services and affiliate marketing sites associated with illegal services.

United States / Canada: compliance pattern

Core concept: jurisdiction fragmentation. Use exact state/province rather than country-wide status.

Step 4 — Notify internal owner/operator where required

Step 5 — Correct control

Not only individual ad.

Step 6 — Review similar assets

Step 7 — Document root cause.

Root Cause Types

Policy Knowledge rule unknown. Process approval skipped. Data wrong GEO/operator status. Technology suppression/routing failure. Human manual override. Vendor sub-affiliate violated rules.

Don't fix only the visible ad

If 200 creatives use same bad template: fix component.

Single Point of Failure

Compliance architecture should avoid: one person's spreadsheet controlling: self-exclusion, operator links, policy rules.

UKGC explicitly warns about single-point failures in self-exclusion marketing controls

Its guidance says it is unlikely to accept that all reasonable steps were taken where a single process failure caused marketing to self-excluded customers.

Compliance by Design

Best compliance systems prevent bad launch automatically.

Example

Campaign builder selects: NL. System disables: influencer creatives. Because: role-model rule.

Example

Select: BR. System loads: current warning component.

Example

Operator status becomes: inactive. CMS removes all outbound CTAs.

Example

User: suppressed = true. CRM refuses send.

Human review still matters

Automated rules can become stale. Legal interpretation can be nuanced.

Automation should enforce known rules

Not invent legal conclusions.

Example: monthly media contribution: $8k. Local compliance/localization: $12k. Fully loaded: −$4k.

Regulatory Complexity Tax

New GEO adds:
  • research;
  • creative variants;
  • monitoring;
  • operator verification.

This supports focused GEO strategy

One well-run regulated market: can outperform 10 loosely managed GEOs.

Compliance and Scaling

The faster you scale: the larger the impact of one mistake.

Example

At: $500/day bad warning template affects: small exposure. At: $100k/day same control failure becomes material.

Scale Gate should include Compliance

Before budget increase ask: Is current approval still valid? Did target GEO expand? Did new creative pass review? Did operator cap/rules change?

Scale / Hold / Stop

Scale

Verified + profitable.

Hold

Economics good but compliance review pending.

Stop

Hard compliance fail.

Compliance overrides ROAS

Campaign: ROAS 300%. Operator authorization suspended. Decision: Stop.

No “temporary exception because campaign performs well”

That creates perverse incentives.

Compliance and Offer Selection

Offer with highest CPA: may have:
  • restrictive sources;
  • poor regulatory process;
  • unclear legal entity.

Offer Quality includes Compliance Quality

Evaluate: Licence clarity contract clarity tracking creative support change communication.

Compliance and Operator Selection

Strong operator should make it easy to verify:
  • legal identity;
  • market permission;
  • approved domains;
  • current terms.

Compliance and Affiliate Agreement

Key sections: Permitted GEOs Permitted Sources Creative Approval Brand Bidding Sub-affiliates Data Clawbacks Termination Post-Termination Revenue. Подробнее: iGaming Affiliate Agreement.

Compliance and Fraud

Fraud-control should identify: VPN mismatch geo mismatch duplicate fake KYC incentivized violation self-referral. Подробнее: Fraud в iGaming affiliate marketing.

Compliance and Attribution

A compliant campaign still needs reliable attribution. Otherwise: you cannot prove which source generated questionable traffic. Подробнее: Атрибуция в iGaming.

Compliance and Landing CRO

Do not remove: warning, terms, disclosure simply because A/B test says: conversion improves without them.

Compliance is a CRO constraint

Optimize: within compliant design space. Подробнее: Landing pages в iGaming.

Compliance and SEO

Do not remove licence/RG information because: “it dilutes keywords”. Search optimisation sits below regulatory correctness. Подробнее: SEO для iGaming в 2026.

Compliance and First-Party Audience

Owned audience is valuable only if: consent/suppression governance is reliable. Подробнее: First-party аудитория в iGaming.

Compliance and Multi-GEO Scaling

Multi-GEO complexity rises approximately with: Markets × Products × Operators × Sources.

Example

5 GEO × 2 products × 5 operators × 4 sources = 200 commercial/compliance combinations. Not all require unique review, but complexity is real.

Reusable compliance modules become essential

Central: Operator Registry Policy Engine Evidence Tracking. Local: GEO rules.

Global Compliance Operating Model

Central Team

Policy architecture. Data. Evidence. Platform accounts.

Local/GEO Layer

Regulation. Language. Advertising restrictions.

Commercial

Operator contracts.

Acquisition

Campaign execution.

CRM

Consent/suppression.

Analytics

Quality/rejection monitoring.

RACI-style ownership

Every rule needs: Owner.

Example

Google certificate: Paid Media owner. Operator licence: Compliance. Offer terms: Affiliate Manager. Suppression: CRM/Data.

“Everyone owns compliance” can mean nobody owns it

Assign named operational owner.

Compliance SLA

Example internal process: P0: immediate campaign halt. P1: same-day review. P2: fix before launch. Exact timing is internal policy, not regulatory standard.

Training

Media buyers should know: not every statute, but: which actions require escalation.

Escalation triggers

New GEO New Product New Operator New Source New Creator New Promotion Type New Data Source.

A minor copy change may not require full legal review

But: new product category probably does.

Change Classification

Low Risk

Typo.

Medium

CTA wording.

High

Bonus proposition.

Critical

New operator/GEO/product.

Evidence Preservation

Keep: policy versions contracts creative approvals operator verification campaign logs.

Retention period

Should be defined based on applicable legal, contractual and internal requirements. No universal global duration.

Audit Trail

Question: Who approved this creative and under which rule version? should have answer.

Compliance Dashboard

Recommended executive metrics: Active GEOs Verified Operators Expired Reviews Pending Hard Gates Policy Changes Open Suppression Failures Wrong-GEO Rejections Unauthorized-link incidents.

Do not use “number of legal reviews” as success KPI

Goal is: safe operational execution.

Useful Control KPIs

% operators current % creatives linked to approval % campaigns with valid platform certificate % compliance reviews within SLA.

Zero is the desired metric for some events

Underage-targeting incidents self-exclusion marketing incidents unauthorized-operator links.

Common Compliance Mistakes

1. “Operator famous = licensed”

Verify entity/domain.

2. “Country legal = product legal”

Product-specific status needed.

3. “Operator licensed = affiliate can advertise”

Affiliate/platform requirements may differ.

4. “Google approved = legally approved”

Different layers.

5. “TikTok allows casino = affiliate comparison allowed”

Not necessarily.

6. “18+ in footer = age compliance”

Targeting/creative can add more requirements.

7. Copying bonus between GEOs

Promotion rules differ.

8. Copying one responsible-gambling footer globally

Resources/rules differ.

9. Not checking sub-affiliates

Opaque supply chain.

10. Using influencer without local role-model analysis

Can be prohibited.

11. Emailing historical database without suppression sync

Self-exclusion/direct-marketing risk.

12. SEO links to expired/unlicensed operator

Organic is still promotion.

13. Hiding affiliate disclosure

Commercial relationship unclear.

14. Treating consultation as law

Wrong legal status.

15. Reviewing policy once a year

Too slow.

Another critical mistake: compliance by memory

“I remember Google allows this GEO.” Not enough.

Policy Memory Decays

Use: source + date.

Current Google example

Its Gambling and Games policy currently says gambling-promoting content not listed for a country may not be advertised in that country. Therefore eligibility must be checked against: current country row, not old campaign history.

Current TikTok example

Policy updated: August 2026. Old 2025 screenshots: not sufficient.

Current UK example

LCCP: version effective from 29 July 2026.

Current Brazil example

SPA legislation index was updated 17 September 2026.

Compliance Freshness is itself a control

Track: Data Freshness.

Pre-click Hard Gate

Simplified: Jurisdiction PASS AND Product PASS AND Operator PASS AND Affiliate PASS AND Contract PASS AND Platform PASS AND Creative PASS AND Landing PASS = LAUNCH.

One failure means HOLD

Not: 8/9 = good enough.

Post-launch Monitoring Gate

Campaign remains active only while: Licence Valid Certificate Valid Offer Valid Creative Valid Audience Valid Tracking Valid.

Compliance Drift

Campaign can be compliant at launch and non-compliant later.

Causes

Rule changed operator status changed offer changed domain changed creative edited audience expanded.

Therefore compliance is a state, not a historical event

Not: approved = true. Better: approved_until / next_review.

Worked Example: Multi-GEO Affiliate

Affiliate operates: GB. Brazil. Netherlands. Australia informational SEO.

Great Britain

Operator: verified. Source: Google. Need: UKGC/contract/CAP/Google certification.

Brazil

Operator: SPA verified. Creative: needs current Brazil requirements. Affiliate framework: monitor ongoing development.

Netherlands

Operator: licensed. Source: SEO affiliate. Need: strict advertising exposure control and no prohibited influencer model.

Australia

Publisher discovers offshore casino offer. CPA: very high. But ACMA framework identifies illegal casino/affiliate promotion risk. Decision: Reject, regardless payout.

This illustrates hard filters

CPA cannot override legality.

Compliance Economics Example

Offer A: CPA $400. Expected contribution: +$100/QFTD. But: operator authorization unclear. Economic EV: not considered until compliance resolved.

Offer B

CPA $220. Fully verified. Contribution: +$60/QFTD. It may be deployable now.

Don't calculate “risk-adjusted illegal CPA”

Compliance is not: probability regulator notices × fine.

Better opportunity set

First remove: ineligible options. Then optimize economics among: eligible options.

Mathematical framing

Let: E = set of compliant eligible segments. Then maximize: Contribution(segment) for: segment ∈ E. Do not optimize across: all available offers then subtract compliance penalty.

Why this matters operationally

It prevents commercial teams from: pressure-testing legal boundaries based on payout.

Compliance Pipeline

Research ↓ Verify ↓ Approve ↓ Deploy ↓ Monitor ↓ Renew / Suspend ↓ Archive.

Research Status

Potential opportunity. No spend.

Verified

Evidence obtained.

Approved

Internal review complete.

Deployed

Live.

Monitor

Ongoing status.

Suspend

Rule/status changed.

Archive

No longer active.

Compliance Documentation Pack

For each live GEO: Regulatory Summary Operator List Affiliate Requirements Platform Matrix Creative Rules CRM Rules Evidence Register Change Log Incident Plan.

One-page GEO Runbook

Keep operational summary concise. Example:

BR

Regulator: SPA. Operator source: SPA registry. Platform: per current policy. Creative: Brazil-specific warning. Review: event-driven.

Detailed legal memo can sit behind it

Media buyer should not need to read 300 pages before every ad edit.

But summary must be sourced

Every rule: source reference.

Compliance Owner should know uncertainty

Use wording: confirmed likely requires counsel not pretend certainty.

When to escalate to specialist counsel

Especially for: new jurisdiction unclear affiliate licensing cross-border entity/tax structure novel promotional model user-data sharing regulator inquiry enforcement notice.

Compliance Checklist for Small Affiliate

You do not need enterprise software initially. Minimum: Operator spreadsheet/database GEO policy sheet contract folder creative approval log suppression process monthly review calendar.

But avoid one uncontrolled spreadsheet

Use: version history and: named owner.

Compliance Stack for Larger Operation

Policy Database Operator Registry Offer Feed CMS Rules Tracker CRM Suppression Warehouse Alerting.

Example Automated Alerts

Operator Review Expired Certificate expires Wrong-GEO rejection +50% New operator domain discovered Policy source updated Offer date expired Self-exclusion sync failed.

Compliance QA before deployment

Automated checks: jurisdiction_id exists operator.status == verified creative.approved == true platform.status == allowed offer.valid_to >= today.

But policy text cannot always be reduced to Boolean

Some rules require: judgement.

Store Human Review Notes

For: talent appeal, advertising interpretation, complex offer.

Avoid “AI says compliant” as sole control

AI/tools can support: classification and: monitoring. Final high-risk decision should follow: current authoritative rules and appropriate human/legal review.

Search / AI Publishing Compliance

For SEO content, clearly separate: fact operator claim your methodology commercial relationship.

Do not fabricate licence details

If regulator register unavailable: say: verification pending.

Absolute dates improve reliability

Instead of: recently changed. Write: effective 14 September 2026.

This is especially important for regulatory pages

Rules change quickly.

dateModified should reflect real review

Do not update date automatically daily without substantive review.

Regulatory Content Version

Example: COMPLIANCE-GB-v2026.09.22.

Global Market Comparison

Area GB Brazil Netherlands Australia
Affiliate enforcement relevance high high/evolving high high
Operator verification UKGC SPA Ksa licence Australian licence/product legality
Youth protection strong explicit strict young-adult controls market-specific
Affiliate ad platform check required required required required
Regulatory monitoring continuous especially frequent continuous continuous
Not a ranking of regulatory strictness.

The purpose is not to find “easiest regulation”

Best compliance strategy is not: find weakest regulator. It's: operate where rules and economics can both be supported.

Compliance can become competitive advantage

Competitor with:
  • stale operator list;
  • poor tracking;
  • weak CRM control
may have cheaper operations today. But infrastructure advantage compounds.

Strong affiliate can update faster

When regulator changes rules: one centralized component updates: 500 pages.

Weak affiliate edits manually

Misses: 40 pages. That is operational risk.

Compliance Moat

Verified data operator relationships policy automation evidence history training change-management speed.

Compliance and First-Party Data

The more owned audience you build: the more important data governance becomes.

Paid click compliance is temporary

CRM creates ongoing responsibilities.

Audience ownership increases responsibility

You now hold: consent, preferences, suppression.

Compliance and Scaling Flywheel

Verified GEO ↓ Compliant Acquisition ↓ Clean Tracking ↓ Reliable QFTD ↓ Stable Operator Relationship ↓ More Capacity ↓ Better Deals ↓ More Scale.

Opposite flywheel

Loose Controls ↓ Bad Traffic ↓ Rejections ↓ Operator Complaints ↓ Clawbacks ↓ Termination ↓ Platform Problems.

Global Compliance KPIs

Track: Verified Operator Coverage = verified active operators / active operators. Creative Approval Coverage = compliant-approved active creatives / total live creatives. Evidence Freshness = records within review window / active records. Geo Rejection Rate = wrong-GEO rejects / Raw FTD. Source Violation Rate = source-related rejects / Raw FTD. Suppression Failure Count = should approach zero.

Compliance metrics are leading business metrics

Because they predict: clawbacks, operator instability, platform disruption.

Final Compliance Operating Principle

Never ask only: “Can we run this?” Ask: “Can we prove why this exact campaign, for this exact operator, product, jurisdiction, audience and channel is eligible today?” If the answer requires: “I think so” status should be: Hold / Verify.

Главное о compliance в iGaming affiliate marketing

iGaming affiliate compliance не сводится к: 18+ или: Responsible Gambling footer. Полная system выглядит так: Exact Jurisdiction ↓ Eligible Product ↓ Authorized Operator ↓ Affiliate Eligibility ↓ Contract Permission ↓ Platform Permission ↓ Audience Eligibility ↓ Compliant Creative ↓ Compliant Landing ↓ Consent / Suppression ↓ Traceable Data ↓ Stored Evidence ↓ Continuous Monitoring. Модель mature affiliate: Compliance Eligibility × Unit Economics × Operational Capacity = Scalable Opportunity.
